Hoodoo Ski Area -- Season Pass Terms & Conditions

1.       _____A Season Pass is non-transferable and non-refundable.  If misused, under any circumstances, the pass(es) will be revoked.   

2.       _____The Season Pass holder agrees to wear the pass on the upper body and show it to the operators at each and every lift boarding.

3.       _____Only legal spouse and legally dependent children living at home (18 years and younger or full time students under 21 years) qualify as Family Pass members. Identification to verify qualifying status for a Family Pass is required at pass purchase.

4.       _____The Junior Pass is for ages 6 - 11 years. A Senior Pass is for ages 65 and older.  Full time students, ages 12 to 18, qualify for Student Pass status. Young adults are ages 19-25.  Children 5 and Under will receive a ticket at no charge or pay a processing fee for a season pass.  Proof of age and student identification is required for NEW Pass Holders at the time of printing passes for Under 5, students, young adult, and seniors.  

5.       _____The Season Pass holder agrees to notify the Ticket Office immediately of a lost or stolen pass. There are no complimentary passes issued.  There is a replacement fee of $35.00 that will apply for Lost or Stolen passes.  If the lost or stolen pass is found or returned, it must be presented at the ticket office to be accounted for and discarded.   

6.       _____The Season Pass holder also agrees to purchase a full day lift ticket if they have forgotten their pass at home. No complimentary tickets. 

7.       _____Hoodoo Ski Area reserves the right to alter opening dates, closing dates and operating hours at any time based on weather and snow conditions. Hoodoo Ski Area reserves the right to determine the number of lifts in operation and/or area open for skiing at any given time based on snow, weather or other conditions.

8.       _____The Season Pass holder agrees to observe all Hoodoo Ski Area and U.S. Forest Service regulations relative to the use of the ski slopes and lift facilities, and to adhere to Your Responsibility Code.

9.       _____Hoodoo Ski Area reserves the right to cancel a Season Pass without refund for negligent actions or behavior and  failure to comply with any of the above conditions and regulations.

10.    _____RELEASE AND INDEMNITY AGREEMENT: Each purchaser and user of this pass agrees to release, indemnify, and hold harmless Hoodoo Ski Area, its directors, officers and agents from any and all claims and liabilities arising from the use of this pass, or the use of any Hoodoo ski area equipment, services, and facilities, including claims based upon negligence. The parent or guardian of any minor with a pass hereunder shall indemnify Hoodoo Ski Area from injuries or property damage incurred by or caused by such a minor. The indemnities hereunder shall include costs and attorney fees incurred by Hoodoo Ski Area.

11.    _____“The purchaser or user of the Season Pass understands that skiing can be hazardous and accepts and assumes the inherent risks of skiing including but not limited to: Changing weather conditions, variations or steepness in terrain, snow or ice conditions, surface or subsurface conditions, bare spots, creeks and gullies, forest growth, rocks, stumps, lift towers and other structures and their components, collisions with other skiers, and a skier’s failure to ski within the skier’s own ability. Always ski in control.”  ORS 39.970-990.

12.    _____The purchaser and user of this pass agrees to comply with the duties of skiers under Oregon law, ORS 30.985, which include but are not limited to the following:

a)                   Skiers who ski in any area not designated for skiing within the permit area assume the inherent risks thereof.

b)                   Skiers shall be the sole judges of the limits of their skills and their ability to meet and overcome the inherent risks of skiing and shall maintain reasonable control of speed and course.

c)                   Skiers shall abide by the directions and instruction of the ski area operator.

d)                   Skiers shall familiarize themselves with posted information on location and degree of difficulty of trails and slopes to the extent reasonably possible before skiing on any slope or trail.

e)                   Skiers shall not cross the uphill track of any surface lift except at points clearly designated by the ski area operator.

f)                     Skiers shall not overtake any other skier except in such a manner as to avoid contact and shall grant the right of way to the overtaken skier.

g)                   Skiers shall yield to other skiers when entering a trail or starting downhill.

h)                   Skiers must wear retention straps or other devices to prevent runaway skis.

i)                     Skiers shall not board rope tows, wire rope tows, j-bars, t-bars, ski lifts or other similar devices unless they have sufficient ability to use the devices, and skiers shall follow any written or verbal instructions that are given regarding the devices.

j)                     Skiers, when involved in a skiing accident, shall not depart from the ski area without leaving their names and addresses if reasonably possible.

k)                   A skier who is injured should, if reasonably possible, give notice of the injury to the ski area operator before leaving the ski area.

l)                     Skiers shall not embark or disembark from a ski lift except at designated areas or by the authority of the ski area operator.

m)                 The words “skier” and “skiers” applies to skiers, snowboarders, snowskaters, sledders, airboarders, snowbikers, tubers, and any person(s) using snow sliding equipment or doing snow sliding activities. 

This agreement to be made part of the 2006-2007 Season Pass Application & Agreement.
